If the ownership of your business changes or your business is involved in an outsourcing arrangement, you are likely to have obligations to any affected employees.

The Transfer of Undertakings (Protection of Employment) Regulations 2006, commonly known as TUPE, may apply where a business, or part of a business, is transferred from one party to another. TUPE may also apply where the provider of services in an outsourcing arrangement changes.

It is important for employers to recognise a situation where TUPE may apply and take legal advice to ensure compliance with the complex requirements of the legislation.
